1. ABOUT THESE TERMS

These Terms of Use are an agreement between you and HEXXO (“HEXXO,” “we,” “us”) and cover the HEXXO iPhone app and links.hexxoapp.com (together, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use HEXXO.

2. WHO CAN USE HEXXO

You must be at least 13 years old to use HEXXO. If you're under the age of majority where you live, you need a parent or guardian's permission. You're responsible for your account and for keeping your sign-in secure.

3. YOUR PHOTOS AND CONTENT

You keep ownership. Photos, captions, spot names, and anything else you post (“Your Content”) remain yours.

The license you give HEXXO. When you post Your Content, you grant HEXXO a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, crop, resize, adapt (for example, to create thumbnails, color palettes, and share cards), and distribute Your Content in order to:

• operate, improve, and show it to people in the Service, including on maps, galleries, share links, and widgets; and
• promote HEXXO, including on our website, social media, App Store listing, press materials, and marketing created with partners such as cities, tourism boards, and businesses.

When we use Your Content to promote HEXXO, we'll credit you by your HEXXO name or handle wherever that's reasonably practical. You can let us know at any time that you'd prefer your photos not be featured in our marketing, and we'll stop using them in new marketing materials. Paid advertisements that prominently feature an identifiable person will only use photos where we've asked for and received permission.

When you delete a photo or your account, this license ends for that content, except for copies already included in marketing materials published before the deletion, copies others have already shared, and backups kept for a limited time.

What you promise us. You confirm that you took the photo or have the right to share it, that sharing it doesn't violate anyone else's rights (including copyright, privacy, or publicity rights), and that anyone clearly identifiable in it is okay with it being shared.

4. LOCATION FOUNDERS AND CREDIT

The first person to post a spot may be credited as its “Location Founder.” Credits, ratings, badges, and similar features are part of the community experience; they aren't ownership of a place, and we may adjust them, for example if a photo is removed or a spot is merged.

5. STAY SAFE AND RESPECT PLACES

HEXXO shows real places, and you visit them at your own risk. Spots may be on private property, change over time, or not be safe to visit. Always follow the law and posted rules, respect property owners and neighbors, and never trespass, climb, or put yourself or others at risk for a photo. HEXXO doesn't guarantee access to, or the accuracy, safety, or condition of, any location.

6. COMMUNITY RULES

Don't post or do anything that:

• is illegal, hateful, harassing, threatening, sexually explicit, or violent;
• infringes someone else's copyright, trademark, privacy, or publicity rights;
• shares someone's private information, or a private home's location without permission;
• is spam, misleading, or impersonates someone else;
• tries to break, overload, scrape, or get around the security of the Service.

You can report a photo or block a user from the menu on any photo. We may remove content or suspend accounts that break these rules, with or without notice.

7. COPYRIGHT COMPLAINTS

If you believe something on HEXXO infringes your copyright, email smith.lasalleii@gmail.com with a link to the content, a description of your work, and your contact information. We'll review it and remove infringing content.

8. YOUR ACCOUNT

You can delete your account at any time in the app (Account → Manage Account → Delete Account). We may suspend or end access to the Service if you break these Terms or if we need to for legal or safety reasons.

9. THE SERVICE ITSELF

We're always improving HEXXO, so features may change or be discontinued. HEXXO's name, logo, design, and software belong to us; these Terms don't give you rights to them beyond using the Service.

10. DISCLAIMERS AND LIMITS

The Service is provided “as is” and “as available,” without warranties of any kind, to the fullest extent the law allows. To the fullest extent the law allows, HEXXO isn't liable for indirect, incidental, special, or consequential damages, or for anything that happens when you visit a location, and our total liability for any claim is limited to $100. Some places don't allow these limits, so they may not all apply to you.

11. CHANGES TO THESE TERMS

We may update these Terms. If a change is significant, we'll let you know in the app or on this page before it takes effect. Continuing to use HEXXO after changes take effect means you accept them.

12. GOVERNING LAW

These Terms are governed by the laws of the State of Illinois, USA, without regard to its conflict-of-law rules.
